End-User License Agreement ("Agreement")

Please read this End-User License Agreement carefully before using the BestWeekEver application.

1. Introduction

This End-User License Agreement ("EULA" or "Agreement") is a legal agreement between you (either an individual or a single entity) and BestWeekEver ("we," "our," or "us") regarding your use of the BestWeekEver web application and related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you do not agree to these terms, you should not use the Service.

2. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

3. Restrictions

You agree not to:

1. Copy, modify, or create derivative works based on the Service
2. Reverse engineer, decompile, or disassemble the Service
3. Rent, lease, lend, sell, sublicense, or otherwise transfer rights to the Service
4. Remove, alter, or obscure any proprietary notices on the Service
5. Use the Service in any way that violates applicable laws or regulations
6. Use the Service to infringe the intellectual property rights of others
7. Use automated means, including spiders, robots, crawlers, or data mining tools, to download data from the Service
8. Interfere with or disrupt the operation of the Service or the servers or networks used to make the Service available

4. User Accounts

To use certain features of the Service, you must create an account and connect it with your Spotify account. You are responsible for:

1. Keeping your account credentials confidential
2. All activities that occur under your account
3. Ensuring that all account information you provide is accurate and up-to-date

We reserve the right to disable your account if we believe you have violated this Agreement.

5. Third-Party Services

The Service integrates with third-party services, including:

1. Spotify: We use Spotify to authenticate users and access their music preferences.
2. Bandsintown: We use Bandsintown's API to gather concert information for artists in your music library.

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, privacy practices, or other policies of these third-party services.

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by BestWeekEver and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

1. THE SERVICE WILL MEET YOUR REQUIREMENTS
2. THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
3. THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE
4. ANY ERRORS IN THE SERVICE WILL BE CORRECTED
5. CONCERT INFORMATION PROVIDED THROUGH THE SERVICE IS ACCURATE, COMPLETE, OR UP-TO-DATE
6. EVENTS WILL OCCUR AS SCHEDULED OR AS SHOWN IN OUR SERVICE

8. Limitation of Liability

IN NO EVENT SHALL BESTWEEKEVER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
3. ANY CONTENT OBTAINED FROM THE SERVICE
4. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless BestWeekEver and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees and costs, arising out of or in any way connected with your access to or use of the Service, your violation of this Agreement, or your violation of any rights of another.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach this Agreement.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

11. Changes to This Agreement

We reserve the right to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Agreement. If you do not agree to the new terms, please stop using the Service.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

13. Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

This Agreement constitutes the entire agreement between you and BestWeekEver regarding the Service and supersedes all prior and contemporaneous written or oral agreements between you and BestWeekEver.
